On February 27, 2014, the U.S. Department of Education, through the Privacy Technical Assistance Center (PTAC), issued new guidance on the proper use, storage, and security of data being generated by third-party providers of online educational resources. The guidance addresses privacy and security considerations relating to computer software, mobile phone apps, and web-based tools provided by a third party to a school or district that students and/or their parents’ access via the internet and use as part of a school. The guidelines provide recommended best practices to schools but are not binding and contain no new legal regulations.
