Uninterrupted Scholars Act (February 2013 School Leader Update)
On January 14, President Obama signed the Uninterrupted Scholars Act, which amends the Family Educational Rights and Privacy Act, better known as FERPA. This bill provides that state or local child welfare agencies do not need parent consent to access personally identifiable information from education records for students who are in foster care or otherwise subject to the juvenile court’s jurisdiction as an abused, neglected, or dependent child. Child welfare agencies may only disclose that information to individuals or agencies involved in addressing the child’s educational needs. This amendment is effective immediately. The amendment also provides that, if a juvenile court order provides access to student records, and the parent is a party to that case, no additional notice to the parent from the school is required.
