Parentally Placed Private School Children with Disabilities

Explanation

Children with disabilities enrolled by their parents in nonpublic, including religious, schools or facilities that meet the definition of elementary school or secondary school.

IEP Development

An IEP must be developed and implemented for each private school child with a disability to receive special education and related services.

IEP Review

A representative of the private school must be invited to attend each IEP meeting. If the representative cannot attend, other methods must be used to ensure participation by the private school, including individual and conference telephone calls.

Parental Consent

Consent must be obtained from the parents of a child who is enrolled or is going to enroll in a private school that is not located in the LEA and AEA of the parent’s residence, before any personally identifiable information about the child is released between the LEA and AEA where the private school is located and the LEA and AEA of the parent’s residence.
