Explanation

When a student’s current IEP is amended changes are made either by the entire IEP team at an IEP team meeting or by making changes to part of the IEP. The IEP is not being completely rewritten.

Amending an IEP does not change the “duration to” date or the date for the student’s reevaluation.

A student’s current IEP can be amended at any time but does not change the "Duration of this IEP" date cannot be changed.

One way to amend an IEP is to convene the IEP team and hold a meeting.

Preparing for the IEP Amendment Meeting

Before the IEP Amendment Meeting the person leading the meeting must:

  • Identify the change(s) that needs to be made.
  • Collect supporting data
  • Decide who needs to be at the meeting
  • Send Meeting Notice
    • The same meeting requirements for an annual review apply to a meeting to amend an IEP.

Follow the IEP process for the areas to be amended. IEP Review

Be sure that there continues to be alignment between the information in the PLAAFP, the goals, progress monitoring procedures and the identified services.

For example, if a goal is being amended be sure that:

  • the data supporting the change in the goal is included in the PLAAFP;
  • the progress monitoring procedure tracks the student’s progress on the goal; and
  • the services described in the IEP support the goal attainment.

Explanation – Amending without a Meeting 

In making changes to a child’s IEP after the annual IEP team meeting for a school year, the parent of a child with a disability and the district or AEA may agree not to convene an IEP team meeting for the purposes of making those changes and instead may develop a written document to amend the child’s current IEP.  These changes can be made via email or phone call.

The district or AEA must be clear about:
  • How the process for amending an IEP without a meeting will work?
  • How will the decision to amend an IEP without a meeting be made?
  • Who will be involved in making the decision to amend an IEP without a meeting?
  • Who will be involved in amending an IEP without a meeting?
  • Will the amendment(s) to the current IEP affect the provision of FAPE?

The agreement between the parent and the district or AEA to amend the IEP without a meeting must be documented.

It is important when amending an IEP without a meeting that the parents are active participants in the decisions that are made regarding the amendments.

Remember that a district or AEA may only agree to make changes concerning resources the district or AEA has the authority to commit. This means that a district cannot commit the resources of an AEA without AEA agreement and the AEA cannot commit the resources of a district without district agreement.

Follow-up/Implementation of the Amended IEP

IEP Team members need to be informed of and see the changes in writing. The purpose of written changes is to assure that:
  • all team members are aware of the changes,
  • everyone impacted by the changes is aware of any new responsibilities in regard to amended IEP, and
  • Free Appropriate Public Education (FAPE) continues to be provided
Implement the IEP as amended.
