Notice for public comment and public hearing regarding IDEA State Application Part C


The Iowa Department of Education is now taking comments from the public as it prepares to submit the State Eligibility/Application document for Part C of the Individuals with Disabilities Education Act (IDEA) and policies, as revised, to the U.S. Department of Education Office of Special Education Programs.

The plan reflects the cooperative efforts of the Department of Education and other agencies to provide a full program of services to all infants and toddlers with disabilities age birth through two and their families. This document contains information required by the U.S. Department of Education for Iowa to continue to receive funding under the provisions of IDEA-Part C. The document contains a submission statement of assurances and a description for use of funds for Part C (Early ACCESS) services available for infants and toddlers with disabilities age birth through two and their families in the state of Iowa. The policies are revised to meet requirements of the IDEA Part C Regulations and align with the Part C Eligibility/Application requirement. This document will be submitted to the U.S. Department of Education prior to April 21, 2015.

The document and comment form are included below. Input may be provided through email to the following address: or submitted in writing via the U.S., Postal Service, carrier service or fax. Each person submitting comments must identify their name, title and address; identify the specific sections of the document they are commenting on; their comment on each section and any recommendations.

Comments must be received by 4PM CDT April 15, 2014 in order to be taken into consideration prior to submission of the document to the U.S. Department of Education.

Public Hearing Notification

The Iowa Department of Education will conduct a public hearing relating to the Individuals with Disabilities Education Act (IDEA), Part C State Eligibility document for the delivery of special education and related services in Iowa.

In order to ensure that all interested parties will have an opportunity to make comments at the aforementioned hearings, the Department of Education recommends the following procedures:

  1. In presenting both oral and written statements, each commenter should (1) indicate his or her name, title and address; (2) identify each specific part of the plan on which comments are being made; (3) describe the concern with respect to the part; and (4) stipulate the recommended action to be taken.
  2. Each person planning to make an oral presentation should (1) prepare a written statement of his or her comments in advance of the hearing; (2) make the presentation as concise as possible; and (3) submit a copy of the prepared statement to the Department personnel present at the hearing.
