Yes. If the district is not the receiving district under open enrollment and if the district is willing to enroll the student, it may do so, but it is not obligated to enroll a non-resident student. If it does enroll the nonresident student who is not otherwise open enrolled in, it must charge tuition — even if it does not charge tuition of its own students because the law requires that an out-of-district student must pay tuition as per Iowa Code section 282.24. However, if the neighboring district is the receiving district under open enrollment. that district becomes the district which is obligated to provided driver education to its open enrolled in non-resident students as per Iowa Code section 321.178.
